It is understood that on October 11, 2016, law enforcement officers from the Jiangmen Environmental Protection Bureau inspected Guangdong Zhulong Paint and found that it had not gone through the environmental impact assessment document approval procedures and needed supporting equipment. The environmental protection and treatment facilities were put into production without approval from the environmental protection department; and wastewater and other pollutants generated during the production process were discharged to the outside world without obtaining a pollutant discharge permit.
Therefore, Jiangmen Municipal Environmental Protection Bureau, in accordance with Articles 41 and 45 of the “Environmental Protection Law of the People’s Republic of China” and Articles 9 and 23 of the “Regulations on Environmental Protection Management of Construction Projects” According to the provisions of Article 21, Paragraph 1 of the “Guangdong Provincial Environmental Protection Regulations”, Guangdong Zhulong Paint has imposed the following penalties:
1. Order to stop production immediately;
2. Fine of RMB 100,000;
Jiangmen Municipal Environmental Protection Bureau stated that the above-mentioned environmental pollution facts are evidenced by investigation and inquiry records, on-site inspection (survey) records, and photos taken during on-site inspections. The fine must be paid in full within 15 days from the date of receipt of this penalty decision. If the fine is not paid within the time limit, an additional fine of 3% of the fine amount will be imposed every day.
In addition, Jiangmen Municipal Environmental Protection Bureau notified Guangdong Zhulong Paint of the illegal facts, penalty basis and proposed penalty decision on October 26, and informed Zhulong Paint that it has the right to carry out Statements, pleas and requests for hearings. The relevant person in charge of Zhulong Paint made a statement and defense on October 31. After review, the Jiangmen Municipal Environmental Protection Bureau believes that Guangdong Zhulong Paint’s statement of defense does not affect the determination of illegal facts.
